ChiPickle Waiver & Policies

Release, Permission, Indemnification and Assumption of Risk

This is an agreement between you and ChiPickle which contains certain releases, assumptions of risk, permissions and indemnifications. By visiting our facilities in any manner, you are unconditionally agreeing to all of the following. Please read carefully regarding your one-time or ongoing use of the facilities and programs offered by ChiPickle. By reading this document and entering our premises or using our services, you are waiving certain legal rights.

Code of Conduct

  • Respect: Treat all other members, visitors, staff, and our facility with courtesy at all times. Conflicts on and off the court must be resolved respectfully.

  • Etiquette: Wear and use activity-appropriate attire and equipment, do not interrupt the play of others, and make every effort to understand and follow the rules of the game.

  • Safety: Use good judgment regarding safe and unsafe behavior, and bring any safety concerns to the attention of staff.

  • Community: ChiPickle is a welcoming community, and everyone is equally valued. Be an ambassador of pickleball and welcome all players.

Violations of these guidelines, in the sole discretion of management, may result in suspension or termination of your membership and/or access to ChiPickle.

Disclosures and Disclaimers

ChiPickle (Chicago Egret Badminton LLC, dba ChiPickle), its members, managers, officers, agents, participants, sponsors, advertisers, owners, and lessors (collectively “ChiPickle”), has adopted the following policies for the safe, respectful, and healthy use of our facilities, events, and programs. These policies apply to your conduct on ChiPickle premises (courts, centers, outdoor areas, parking lots, sidewalks, etc.) as well as ChiPickle events and sponsored activities.

Privacy Policy
By providing your contact information and communicating with ChiPickle (via website, email, text, advertising, or third-party platforms), you consent to ChiPickle contacting you and using the information provided. You also release ChiPickle from any liability regarding the intentional or unintentional use or dissemination of this information.

Accessibility
If you have difficulty accessing our website, facilities, or offerings, please contact us and we will provide the information or service through alternative, accessible means consistent with applicable law.

Photo & Video Consent
You acknowledge that photos and video may be taken during your use of our facilities and may be used in print, digital, and social media without limitation. By entering our premises, you waive any rights to compensation or royalties. You also release ChiPickle from any liability related to the use or distribution of such images.

Trademarks
ChiPickle™, our logo, and any related designs or slogans are registered trademarks. They may not be used without prior written consent.

Health and Safety

While ChiPickle policies are designed to promote health and safety, participation carries risks including, but not limited to, injury, illness, or property damage. By participating, you confirm you are physically and mentally capable of doing so and assume all associated risks.

Assumption of Risk & Waiver of Liability

You understand that use of ChiPickle’s premises, facilities, services, or participation in events involves risks including slips, falls, equipment failure, theft, accidents, and injuries. Injuries may include, but are not limited to: death, paralysis, concussions, fractures, muscle injuries, allergic reactions, emotional distress, or economic loss.

By entering ChiPickle, you:

  • Assume all risks associated with ChiPickle facilities and services.

  • Waive and release ChiPickle from any claims (known or unknown), including negligence claims, arising out of your use of ChiPickle premises or participation in its programs.

Defense and Indemnification

You agree to defend, indemnify, and hold harmless ChiPickle from any claims brought by third parties arising out of your, your children’s, or your guests’ use of ChiPickle facilities and services.

Minors

ChiPickle is primarily an adults-only facility. All players must be 18 years of age or older. If a parent or guardian chooses to bring a minor as a non-participating guest, the parent/guardian accepts full responsibility for the conduct, safety, and welfare of the minor at all times. ChiPickle does not provide childcare services and assumes no responsibility or liability for minors on the premises.

Under the age of 18 must be accompanied by a parent or legal guardian. Parents/guardians accept full responsibility for the conduct, safety, and welfare of their minor children at all times while on ChiPickle premises.

Prohibited Conduct

No alcohol, drugs, or illegal substances are permitted on ChiPickle property. Disorderly, unsafe, or disruptive behavior may result in immediate removal from the premises and termination of membership or access, without refund.

Right to Refuse Service

ChiPickle reserves the right to refuse service, access, or participation to any person at its sole discretion.

Arbitration

Any disputes shall be resolved through binding arbitration in accordance with United States Arbitration & Mediation Rules. The arbitrator’s decision shall be final and enforceable.


Parking Policy

  • Parking areas are provided only for current ChiPickle members and guests who are actively using the facility.

  • Parking is permitted only during your stay inside ChiPickle to play or participate in activities.

  • Overnight parking is not allowed. Parking for the purpose of leaving the premises to visit other locations is strictly prohibited.

  • All vehicles must be parked in designated areas. Unauthorized or improperly parked vehicles may be towed at the owner’s expense.

  • ChiPickle assumes no responsibility or liability for any damage, theft, loss, or injury involving vehicles or persons while using the parking facilities. All risks and losses are the sole responsibility of the vehicle owner.

  • Our contracted towing company has full authority to tow vehicles that violate these rules, and ChiPickle bears no responsibility for such actions.

Agreement

By reading this document, paying for membership, entering the premises, or using ChiPickle’s facilities in any way, you unconditionally agree to all ChiPickle policies. You acknowledge you have been encouraged to seek independent legal advice prior to participation.

ChiPickle reserves the right to update these policies at any time. You agree to review and comply with the most current version of this waiver and policies before each visit.
